The Digital Personal Data Protection Bill 2023 has been successfully tabled in the Parliament of India and has received the final assent of the President of India. The work to implement this Act has already started. The Act was introduced six years after the Supreme Court declared privacy as a fundamental right.

Under this new law, organizations called data fiduciaries will now be required to introduce security features for the digital data they receive from individuals. Organizations should appoint a Data Protection Officer to help users resolve data issues. Apart from that users get full control over their personal details. Companies that fail to follow this rule will be fined.
Important rights and responsibilities set out in this Act include the right to know where their information is being used, to amend and delete personal information, to resolve issues related to personal information and in certain cases the option to appoint a proxy to exercise rights. There is no doubt that this Act will be a significant milestone in India’s data protection journey.
